Terms of service

These terms are a convenience translation. Only the German version is legally binding.

§ 1 Scope and provider

(1) These General Terms and Conditions (hereinafter “Terms”) apply to all contracts concluded between you and us via the KALDSTUDIOS online shop. The provider and your contractual partner is:

KALD STUDIOS GmbH
Königsallee 19
40212 Düsseldorf
Germany
represented by the Managing Director Jennifer Schmidhofer
Register court: Amtsgericht Düsseldorf, HRB 114652
Email: info@kaldstudios.com

You can find further details in our Legal Notice.

(2) The version of these Terms valid at the time of your order applies. We do not accept deviating terms of the customer unless we expressly agree to their validity in writing.

(3) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its trade, business or profession (Section 14 BGB).

(4) Our online shop is operated on the Shopify platform. Shopify only provides the technical infrastructure and parts of the payment processing; purchase contracts are concluded exclusively between you and KALD STUDIOS GmbH.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.

(2) You can select products from our range and collect them in the shopping cart. In the checkout, you enter your contact, delivery and billing details and choose the shipping and payment method. Before submitting your order, all details are shown to you again in an overview, where you can identify input errors and correct them using the “Back” function or by editing the relevant fields. By clicking the order button (“Order with obligation to pay” or “Pay now”), you submit a binding offer to purchase the products in the shopping cart.

(3) Immediately after submitting your order, you will receive an automatic email confirming receipt of your order. This confirmation of receipt does not yet constitute acceptance of your offer.

(4) The contract is concluded as soon as we accept your order by a separate email (order or shipping confirmation) or ship the goods to you – whichever occurs first. If we do not accept your offer within five business days, you are no longer bound by it. In this case, we will refund any payments already made without undue delay.

(5) The language of the contract is German.

§ 3 Storage of the contract text

We store the contract text and send you the order details and these Terms by email. You can also view and print these Terms on this page at any time. If you have created a customer account, you can view your past orders there.

§ 4 Prices and shipping costs

(1) All prices stated in the online shop are final prices in euros and include statutory VAT.

(2) Shipping costs may apply in addition to the stated prices. Their amount is shown on the product page or in our Shipping Policy and, at the latest, in the checkout before you submit your order.

(3) For deliveries to countries outside the European Union, further costs such as customs duties, taxes or fees may arise which are not charged by us but by the competent authorities or carriers and are to be borne by you.

(4) If special conditions apply to promotions or vouchers, we will point this out in the respective promotion.

§ 5 Payment

(1) The payment methods available in each case are shown in the checkout, e.g. credit card, Apple Pay, Google Pay, Shop Pay or PayPal.

(2) The purchase price is due upon completion of the order. Payment is processed by the respective payment service provider; its terms may apply in addition.

§ 6 Delivery

(1) We deliver to the countries stated in our Shipping Policy and in the checkout, to the delivery address you provide.

(2) The delivery time is stated on the respective product page or in the checkout. For prepayment methods, it begins on the day after receipt of payment; otherwise on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, it ends on the next business day.

(3) If an ordered product is unexpectedly unavailable, we will inform you without undue delay. In this case, we will refund any payments already made without undue delay.

§ 7 Retention of title

The goods delivered remain our property until full payment has been made.

§ 8 Transfer of risk

(1) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to you upon handover to you or to a person authorised by you to receive them.

(2) If you are a business, the risk passes to you when the goods are handed over to the carrier.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details, the conditions and consequences of withdrawal and the model withdrawal form can be found in our withdrawal policy.

§ 10 Warranty

(1) The statutory rights for defects apply.

(2) Colours and the appearance of the products may differ slightly from their presentation in the online shop depending on the screen and device settings. Your statutory rights in the event of deviations from the agreed or customary quality remain unaffected.

(3) If you are a business, the limitation period for claims for defects is, notwithstanding paragraph 1, one year from delivery of the goods; Section 377 of the German Commercial Code (HGB) remains unaffected. This shortening does not apply to claims for damages under § 11 or in the event of fraudulent concealment of a defect.

(4) If goods are delivered with obvious transport damage, please complain about this to the delivery person immediately if possible and inform us. If you do not do so, this has no effect whatsoever on your statutory claims; however, it helps us to assert our own claims against the carrier or the transport insurance.

§ 11 Liability

(1) We are liable without limitation

  • in the event of intent and gross negligence,
  • for injury to life, body or health,
  • in accordance with the German Product Liability Act and
  • to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical of the contract at the time the contract was concluded. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded.

(4) The above limitations of liability also apply in favour of our legal representatives, employees and vicarious agents.

§ 12 Customer account

(1) You can create a customer account in the online shop. There is no entitlement to this. Please keep your details up to date and your login details secret.

(2) You can have your customer account deleted at any time; a message to info@kaldstudios.com is sufficient. We may terminate your customer account with reasonable notice; the right to extraordinary termination for good cause, for example in the event of misuse, remains unaffected. Purchase contracts already concluded remain unaffected.

§ 13 Use of the online shop

(1) When using the online shop, any actions that violate applicable law, infringe the rights of third parties or impair the operation of the online shop are prohibited, in particular introducing malware and circumventing security or access restrictions.

(2) Automated access to the online shop by bots, scrapers or AI agents is only permitted if the respective program identifies itself as such in its requests (e.g. in the user agent) and complies with technical restrictions set by us. We are entitled to technically limit or prevent automated access.

§ 14 Reviews and feedback

(1) If you send us reviews, comments or other feedback, you grant us a simple, free-of-charge right of use, unlimited in time and space, to publish this content in the online shop and on our own channels.

(2) You are responsible for ensuring that your content is truthful and does not infringe the rights of third parties or legal regulations. We may remove unlawful or offensive content.

§ 15 Copyright and trademark rights

All content of the online shop, in particular texts, photos, graphics, logos and the design, is protected by copyright or trademark law. Use beyond private use is not permitted without our prior consent.

§ 16 Data protection

Information on the processing of your personal data can be found in our Privacy Policy.

§ 17 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or problems, you can reach us at any time at info@kaldstudios.com.

§ 18 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, you retain the protection of the mandatory provisions of the law of that country.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office in Düsseldorf.

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory provisions.
